During the lesson, the topics related to the protection of animal welfare were explored in depth, both from a legislative and jurisprudential perspective, at both the European and national levels.
With regard to European Union law, particular attention was given to Article 13 of the Treaty on the Functioning of the European Union (TFEU), which recognizes animals as sentient beings and requires Member States to pay full regard to their welfare needs. The practical implications of this provision were also examined, in light of the most recent case law of the Court of Justice of the European Union.
At the national level, the analysis focused on Article 9 of the Italian Constitution, as amended by the recent constitutional reform (Constitutional Law No. 1/2022), which expressly introduced the protection of the environment and animals.
